REFLECTIONS ON THE (IN)EFFICACY OF ENVIRONMENTAL MANAGEMENT RESTRICTED TO REGULATORY ASPECTS: CHALLENGES AND OPPORTUNITIES

Abstract

The effectiveness of corporate environmental management has become a central theme in light of the challenges posed by the global socio-environmental crisis and the limitations of traditional models focused on legal compliance and economic incentives. This article critically analyzes the limits and challenges of an environmental management approach restricted to these instruments, questioning its capacity to effectively promote sustainability. A qualitative, exploratory, and theoretical-reflective approach is adopted, based on a structured literature review and content analysis. The study examines high-impact scientific publications, legal norms, doctrines, and jurisprudence at both national and international levels. The results indicate that models based exclusively on legal compliance and certifications, such as ISO 14001, are insufficient to address the complexity of contemporary environmental challenges, particularly in Brazil, where enforcement weaknesses and a lack of integration among governance actors are significant issues. The study highlights that collaborative governance models, involving the State, the private sector, and civil society, are essential to align environmental management with corporate and global sustainability goals. It concludes that effective environmental management requires robust socio-environmental governance, the integration of cultural, social, ethical, and institutional dimensions, and the adoption of technological innovations such as green taxonomy, sustainability due diligence, blockchain, artificial intelligence applied to environmental compliance, and nature-based solutions.
