COMPULSORY LICENSING AND COVID-19: BETWEEN THE EFFECTIVENESS OF PUBLIC HEALTH POLICIES AND THE PERSPECTIVES OF INTERNATIONAL POLICY

Abstract
During the emergence of COVID-19, a series of actions have been designed to effectively fight the pandemic. The compulsory licensing of drugs, medicines, vaccines and other medical and hospital utensils arose with the aim of promoting, according to the rules of international economic law, more precisely of the TRIPS Agreement, in addition to national legislation, a possibility with which developing countries, in general, very populous and with economic and logistical problems in order to obtain access to treatment for COVID-19. Based on a qualitative, exploratory and reflective methodology, despite the good humanitarian arguments in defense of patent infringement, we came to the conclusion that, among international and internal regulations, the effectiveness of the measure is not so positive and, in terms of relations international, has populist and ineffective characteristics due to trade secrets and know-how, necessarily used in pursuit of the application of public health measures.
