REVISITING SCHOOL BULLYING AND CYBERBULLYING FROM A LEGAL PERSPECTIVE

Abstract
The concepts of bullying and cyberbullying refer to a set of varied forms of violence carried out by one or more aggressors, usually repeatedly, in the school context, in the first case, and in virtual environments in the second case. Based on these concepts, the book, “Bullying and Cyberbullying in Schools: Civil Liability as an Instrument for the Protection of Personality” focuses on analyzing civil liability as a legal mechanism to protect personality rights against bullying and cyberbullying practices in the school environment. The book aims to examine the institution of civil liability in its various functions and evaluate its effectiveness in safeguarding personality in cases of systematic intimidation in schools. The research employs a hypothetical-deductive methodology with a bibliographic and documentary approach, based on infraconstitutional legislation. The work explores whether civil liability is sufficient and effective as a legal tool to protect personality rights in cases of systematic school intimidation, including traditional and digital forms (bullying and cyberbullying). The authors conclude that civil liability, as a flexible and multidimensional legal institution, is suitable for protecting personality in cases of school bullying and cyberbullying. However, they emphasize the need to integrate this approach with preventive educational practices, as the absence of preventive measures against bullying exacerbates this form of systematic, intentional, and repetitive intimidation.
