FREEDOM OF INFORMATION AND THE RIGHT TO BE FORGOTEN: A CRITICAL ANALYSIS BETWEEN THE BRAZILIAN AND EUROPEAN COMPARATIVE LAW

Abstract
This study examines the apllicability of the right to be forgotten in relation to freedom of information, through na analysis between the Brazilian State and comparative law, mor especifically, the European Union. The research is based on the premise that the right to be forgotten is essential to guarantee the personality rights protected by the 1988 Federal Constitution to the detrimento of freedom of intormation caused by digital transformation. Using a deductive methodological approach and legal hermeneutics, the research was based on extensive bibliographic and documentar reviews, highlighting recente jurisprudence from Brazilian Courts, especially the Federal Supreme Court, as well as data from the European Union. The results indicate that the Federal Supreme Court understands that the right to be forgoten is not compatible with the Brazilian legal order. This is mistake, considering that freedom of information cannot harm the rights of the individual personality, especially thse who have already served possible sentences for crimes committed in the past. In comparativ law, protection in relation to the right to be forgotten is notorius demonstranting the need for consideration in relation to the rights involved.
